President Mr Mukat
Behari & the managing committed formed the sub committee comprising of me &
other members to understand the ongoing High Court case & meet the lawyer.
I had submitted my findings & gave my letter to Mr Mukat Behari on 22nd
Mar’13 and requested to have an urgent managing committee meeting on 24th
Mar’13. But just after receiving my
letter and without understanding the high court case, he takes the decision by himself along with Mr. Giri Khanna
to sign the court rejoinder in urgency and that too without informing me &
the sub committee members. I had opposed the present
rejoinder made by lawyer because it only further drags the case and not helps
in closing it. I am totally surprised as
to why the President is mis-using his position since no power has been
delegated to him by the managing committee.
Background of High Court case:

Society has an ongoing case against the misuse of opening the corporate office
in Local Convenience Center located in front of C4 to C6 plots Geetanjali
Enclave . Society has hired the advocate Mr Agarwal who lives in plot C-7
Geetanjali Enclave and Society had paid apprx.
Rs 2 lakhs so far for all his fees & hearings.
After
studying the High Court judgments online and the Master Plan of Delhi 2021, I
could conclude that this case can go in our favour in case we all think jointly on the
below mentioned facts.
Following
are the important facts:
1) Use of “Offices” in
Convenience Shopping Center can be permitted but it has to comply with the
definition as given in the Table 5.5 of Master Plan 2021 (Gazette of India:
Page 30, 32 & 37 ). Since this
Corporate “Office” is NOT catering to the day to day needs of local population
of up to 5000 residents living in Geetanjali Enclave & nearby colonies ,
this Corporate office of 3000Sqft which has turnover of 1250 Crores CANNOT BE allowed to function from
Convenience Shopping Center inside Geetanjali Enclave
2) As per Master Plan 2021 this Corporate Office should function from
Local Shopping Center or Community Center which are less than 1Km from our
Geetanjali Enclave
